This is a translation of the Italian text. If the two differ, the Italian version prevails.

These terms apply to the sagomahome.com website and to the Sagoma Home app on phones, computers and in the browser (app.sagomahome.com). By using Sagoma Home, or by creating an account, you accept them. We have written them as simply as possible: if anything is unclear, write to us at [email protected].

Who we are

Sagoma Home is a service run by Marco Di Spena, a private individual. For now Sagoma Home is free and sells nothing.

What Sagoma Home is

With Sagoma Home you draw the floor plan of a home, see it and walk through it in 3D, furnish it with the catalogue and export it as an image, PDF, DXF or IFC. Some features use our servers: the account, "Contact a professional", "Have a shop furnish it", manufacturers' real furniture and the survey on coming features.

  • It is free. There are no payments, subscriptions or purchases in the app.
  • Coming features. Some features, such as reading floor plans with AI, are not active yet: the app shows them as "Coming soon" and asks whether they would be useful to you. Answering is not an order or a booking and does not commit you to anything.
  • If one day there are paid features, we will first change these terms (section 15) and you will always see the price before paying. What is free for private users today will not become paid without notice.
  • We may improve, change or remove features.

Measurements are an aid, not a design

Sagoma Home helps you imagine and organise your home. It is not a professional survey or a construction design, and it does not replace a qualified technician.

  • Measurements, square metres and material estimates may contain errors. Check them before buying, ordering made-to-measure furniture or doing works.
  • Guides and tips give general indications. For a specific home, your municipality's rules and a technician's opinion are what count.
  • Catalogue furniture, including manufacturers' real furniture, are indicative models: the real dimensions, colours and appearance of products are given by the manufacturer or the shop.
  • Load-bearing walls, systems and building permits always require a professional.

Account

  • You create the account with your email: we send you a code to log in, with no password. Use an email that is yours and that you can access.
  • You must be at least 14 years old; under 14, a parent's consent is needed.
  • An account is personal. You are responsible for what is done with your account: if you think someone else is using it, log out of all devices and write to us.
  • You can delete the account whenever you like, from the app (Account → "Delete account"). Your projects stay on your device.

Free trial for professionals, shops and manufacturers

  • Verified professionals, shops and showrooms and manufacturers (section 6) use the services for companies in a free trial: the directory and public profile, requests from private users, furnishing proposals and furniture in the catalogue.
  • The trial has no end date. We do not ask for a card or any other payment method, there is no price and nothing renews for a fee.
  • It can end, but with notice. We may end or change the trial by notifying you by email at least 30 days in advance. If paid services exist afterwards, continuing will be your free choice: without your explicit agreement you pay nothing and simply no longer use the paid services.
  • We may limit the places in the trial, the number of pieces of furniture per manufacturer or of jobs in the profile. You see the limits in the app or on the manufacturers' page.
  • You use these services for your professional activity: for this reason the consumer rules of the Italian Consumer Code do not apply.

Professionals, companies and shops

  • Verification: for the "Verified" badge and the free trial we check your data on INI-PEC or the Business Register and send a code to the PEC address listed there. You give us true data and tell us if it changes, for example if you are no longer on the professional register or if the company closes.
  • "Verified" only means that, at the time of the check, you were on a professional register or the Business Register with an activity in the sector, and that the PEC address was yours. It is not a judgement on the quality of your work.
  • Directory and requests: if you are in the directory, you receive requests from private users in your area who choose you. You use them only to reply to that request and for the work they ask of you, as an independent data controller, in compliance with the GDPR. You do not use them for advertising and you do not pass them on to others.
  • The plans you send: when you reply to a request with a plan, you authorise the private user to use it, modify it and keep it in their Sagoma Home for their home. All other rights to your design remain yours.
  • Furnishing proposals (shops): you use the home you receive only to prepare the proposal for that client. The price you write in the proposal is your own indication: any sale is between you and the client, under your terms.
  • The public profile: if you are verified you have a public profile, in the app and on a web page that search engines can find. What you put in it is your choice and your responsibility: true texts, only jobs done by you, photos you hold the rights to. Photos of a client's home require the client's consent; do not show recognisable people, number plates, addresses or other client data. You give us permission to show the profile in the app and on the web until you hide or remove it. We may hide the profile or remove a job that does not follow these rules.
  • How we order the directory: verified professionals first, then those closest to the city of the home, among those who do the requested work. Nobody pays to rank higher.
  • Suspension: we may suspend you or remove you from the directory if you do not follow these terms, if your data is no longer true or if we receive well-founded reports. We tell you the reason and you can reply. For changes to these rules that concern you, we notify you at least 15 days in advance.

Manufacturers' furniture

  • Verified companies can upload their real furniture (3D model, dimensions, photos, link to the product page, description) from the manufacturers' page. Private users see it under "Real furniture".
  • Rights: by uploading a piece you declare that the company has the right to use the 3D models, photos and texts, and you grant us, free of charge and non-exclusively, permission to show them in the app and on the website and to let people download them in the app to place them in their projects.
  • Correct data: dimensions, name and link must be the real ones of the product, and the link must lead to your website.
  • Check: we check every piece before it enters the catalogue. We may refuse it, telling you the reason: you correct it and send it again.
  • When it leaves: a piece you remove, or that belongs to a deleted or suspended account, can no longer be chosen, but stays visible in the projects that already use it. The same applies if the free trial ends (section 5).

Relationship between private users, professionals and shops

Sagoma Home puts private users, professionals and shops in touch, but does not take part in their agreements and does not sell furniture. Quotes, proposals, contracts, works, prices and payments are solely between the private user and the professional or shop, who are responsible for them. Unverified professionals are marked as such: if you choose them, the assessment is yours. If something goes wrong, write to us: we can act on the directory, but we are not a party to the contract.

What you may not do

You may not use Sagoma Home to:

  • upload or send content that is illegal, offensive or infringes the rights of others (for example floor plans, photos or 3D models you have no right to use);
  • send fake or mass requests to professionals and shops, or use their contacts for other purposes;
  • give false data, especially in the verification of professionals or in furniture listings;
  • get around the limits or the free trial, or create several accounts to do so;
  • copy, resell or mass-extract the catalogue, the models or the software, or take the app apart beyond what the law allows;
  • disrupt the operation of the servers.

If you do not follow these rules we may limit or close your account, after notifying you where possible.

Reporting illegal content

If you find content in Sagoma Home that you believe is illegal (for example in a request, in a reply, in a professional's profile or among manufacturers' furniture), write to [email protected] with the subject "Report". Say where you saw it, why you think it is illegal, your name and your email, and confirm that the report is made in good faith. We reply with our decision and the reason. If we remove content or restrict an account, we also tell the person responsible, with the reason, and they can reply.

Your content

Your projects are yours. You only give us permission to use them to do what you ask: for example to send the plan to the professionals or the home to the shop you choose. Make sure you have the right to use the floor plans and photos you upload.

Our software and the catalogue

The app, the Sagoma brand, the texts and the graphics are ours or used under licence. We give you the personal, non-exclusive right to use the app for your projects, including for work. The catalogue's 3D models come from Poly Haven, Sweet Home 3D and Objaverse, under CC0 and CC BY licences: authors and licences are in the app, under "Sources and licences". Real furniture belongs to its manufacturers, who give us permission to show it (section 7). Names, images and models of companies' products belong to their owners.

Sagoma Home may take you to the website of a shop or a manufacturer. What you buy there, you buy from them, under their terms: they decide prices and availability. Some of these links may be affiliate links: if you buy, Sagoma Home receives a small commission, at no extra cost to you. We say so next to the link.

Liability

We do our best to make Sagoma Home work well and keep your data safe, but we cannot promise that it will always work, without interruptions or without errors. Keep a copy of important projects (Projects → ⋮ → "Export .sagoma file").

To the extent permitted by law, we are not liable for indirect damage, such as work or purchases decided only on the basis of the app's measurements without checking them (section 3). We do not limit in any way our liability for wilful misconduct or gross negligence, for personal injury, or the rights the law gives consumers.

Changes to these terms

We may update these terms, for example when we add features or the law changes. If the change is important we tell you in the app or by email at least 15 days before it applies; for the end of the free trial at least 30 days before (section 5). If you do not agree, you can stop using the service and delete the account.

Law and jurisdiction

Italian law applies. If you are a consumer, you keep the rights given to you by the law of the country where you live, and disputes fall under the court of the place where you live. In other cases the court determined by law has jurisdiction. Before going to court, write to us: we always look for a solution together.

These terms exist in Italian, English, French, Spanish and German. If the versions differ, the Italian one prevails.
